If the H1-B holder's labor is pending for at least a year then an 1 year extentions are granted. If the H1-B holder has an approved I-140 petition, the extention is granted for 3 years. I'm on my 9th year of H1B.

I think it can be. When starting the employment based GC process, one of the question asked was ... has any family member ever applied for your immigration petition in the past. Just an educated guess... check with an attorney
This is not the purpose of this question you mentioned. This can't be done as is specifically not allowed in INA to transfer priority date from FB to EB. This is written into the INA 203(b)(1)(2)and (3). One can only transfer priority dates FB to FB and EB to EB but not otherwise.

One may enjoy only one status (either H4 or H1) at any point of time. So if your wife is on H4 there is no "still valid H1". That said,
1] The COS from H4 to H1 will not be counted against the annual cap in this case - see Dec 2005 (or 2006) memo.
2] I am not sure what your trying to ask but COS from H4 to H1 will not be counted against for next year's annual cap.
3] See Processing Center dates

All,
I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. Responses will be appreciated. Thanks!
an EAD requires a sponsoring company. So, it is in your best interest to find an employer immediately and apply for AC21. If at the time of renewal they ask for employer documents, then your renewal will not be processed and your EAD/AP withdrawn.

I have a B1/B2 visa that I'm thinking about coverting into F1 visa when I get into the US I just have few questions:
1- How long does it take to convert the B1/B2 visa into an F1 visa?
2- If my visa gets converted into the F1 visa, does that mean my B1/B2 visa is cancelled and I have an F1 visa or what am I?
2- Will it be possible to leave the country for few months(after the conversion of my B1/B2 visa into the F1) and then return back to the US with ease to continue my studies ?

but i can think of..
1) cancel the insurance
2) apply for another insurance effective from your return date, cancel the existing insurance.
3) take min liability only
4) see if they can suspend it for 2 months.

I recently got my EB1 I-140 approved. Now my lawyer wants to apply for the I-485 but I am unemployed currently. What are my options in this case? Do I show I am self-employed and apply the I-485 or wait till I get a job.
Just as a background I already have a EB2 Employer based I-485 in process and therefore have the EAD and AP in hand. The EB2 I-485 was applied in 2007 so it is past the 180 days period.
Urgent help will be greatly appreciated.

I believe you have to be in the US when your 140 is applied. Same goes for 485. Check with your lawyer. Once 140 or 485 is applied, you can travel outside.
For 485 you do indeed need to be in the US (for yoiu adjust status, you need to be in some status in the US). However for I-140 you need not be in the US. Can you point to any law or any link on any forum that says you need to be present for filing the I-140?
The complete GC process can be done without ever entering the US (do LC, file I-140, then do Consular processing for the final stage)

Check the I-94 date on the previous extension. If she overstayed beyond that date it could lead to 3/10 year bar depending upon her period of overstay. USCIS rarely ever grant extension for more that 6 months after the initial six month admission.
my mothe in law is visiting us. she came to the Us last Aug 2006 as a B2 (tourist visa). we extented her visa once which iwas valid for Aug 8, 2007. then we applied for the extention again. yesterday we received the letter saying USCIS is not going to extend the visa anymore. the application had been rejected. but they didn't mentioned any date in the letter about when she have to go back.
what is safe for her? does she have any deadline to go back? is it 15 days or a month....
someone please let me know...thanks ahead

This thought occured to me this morning and wanted to bounce off. Feel free to trash it if it is not practical.
I have seen somewhat lukewarm response to Fund raising and I feel there is potential to multiply the effect.
If there is a way for IV to match up clients and IV members for part time efforts and the revenue going to IV, I think it will have bigger impact in terms of fund generation.
How it can work?
Assuming core team and extended leadership team at IV has networked into the Industry, it can get pieces of work carved out. These deliverables are those that can be collaborated on, worked on remotely.
These need not be necassarily in IT. It could be in advertising, acocuonting, graphic designing etc.
IV will seek volunteers interested in participating in this initiative and build skills database and try matching up with the services required.
All the revenue from such services will go to IV.
For IVians who volunteer, besides satisfaction of contributing to the cause, industry networking is a nice offshoot.
This may be my opinion, but volunteering is easy if it is something you do as your second nature.
I have seen few non-profit organizations provide services for a fee. I am not sure what restrictions are placed on IV from a taxation point of view. But over time, the fund raising wing of IV could be delivering on some niche solutions. I am sure some sympathetic corporations would be supporting by providing work.

I have H1 from a consulting company.Now the client I work for has asked me if I'd like to join their company.The problem is they won't sponsor H1's.I'm willing to talk to an attorney and pay expenses for transfer.Can someone tell me if it's possible.If yes then what are the supporting documents we need from the client to transfer?
