    Folks,

    Is there a time limit to transfer a H1-B visa ? If the previous company revokes the H1-B visa how long do we have or is the H1-B canceled at that point ? Please let me know at your earliest.

    Deepadandamudi,

    Because you are not currently invalid non-immigrant status, you are not entitled to a change of status to H-1. But, once an H-1 petition is approved on your behalf, you can leave the US, obtain an H-1 visa stamp in your passport and then return to the US using that visa. Unless your employer is exempt from the H-1 cap, the earliest you could do this would be Oct. 2010.

    As long as you remain legally married you are entitled to the EAD, and you can maintain both documents. However, if you work for another employer using your EAD you will violate your H-1 status.

    Hello,

    I would appreciate any help on the below matter. Thanks in advance!

    My information:
    ----------------------
    Priority Data: March 2008
    I-140 approved
    About to apply for 3 year extension of H1B after 6th year( which expires on Dec 1st 2011)

    My Questions
    ----------------------
    If I move to another company as soon as my 3 year H1B extension comes through and they start my GC process again, what do I have to be careful about regarding
    1. Is this even possible?
    2. Will the H1B keep getting extended after I switch employers.
    3. Can I keep my PD?
    4. If the new company is in a slightly different field but my job remains similar, does that matter?
    5. What happens if after I transfer, my current employer revokes my i-140? Does that matter since my new employer will restart my GC process anyway? (Also, do i get to keep my PD in this case?)

    That's not completely true. There are improvements in UCIS processing. If you check H1 or I-140 processing time 2 years back , it was much worse then. I dont think USCIS processing time is a problem for us right now. Of course it would be nice to have faster service for H1 and I-140 or 485.

    Hi Gurus,
    Please advise me regarding my situation
    My current H1B expires May 1s1 and I have my H1B extension pending (in lieu of GC pending with the same company, and EAD is not an option for me because of dependents) with a fortune 500 company A, with whom I am employed. They plan to do a round of layoffs in a couple of weeks that I am sure my team is a part of.
    With the foreknowledge of pending situation, please let me know if I can validly take the following course of action.
    I am thinking that I premium process my 3 year H1extension with company A right away, then have it transferred to company B. Only problem is extension starts in a future date, ie May 1st.
    Can I get my current+extended H1B transferred to company B even before the start date of extended May1st . If I have to wait till May1st to get it transferred, does it matter that on May 1st I am not with company A anymore.

    clif, I wouldn't worry too much regarding the interview. Just take the latest paystubs, Employment letter from your new employer and all the evidence that you have to prove that you have been legally maintaining status in the country. Since you have already submitted medical exam results you don't need to take them with you.

    They usually just send a standard letter without checking any items in the list.

    Hello All,
    I have couple of questions regarding Travel Document or Advance Parole.

    My EAD has already been filed by my Lawyer but she is charging too much for filing Advance Parole or Travel Document,so here goes my questions.

    - Is there a way to file for Travel Document myself, without involving the lawyer and if yes how can i do that

    - Do I need to wait for my EAD Receipt being sent to me before filing for Travel Document.

    There is a memo which says that you can get 1 year H1 till u get the license.

    However I am not sure if RN positions quality for a h1-b. There was a 50,000 green cards nurses category a cpl of years back for nurses because nurses do not quality for h1. However they did not extend the category.

    Hi All,
    I have filed an extension for my parents B2 Visa. I have got extension approval but only got I-94 for father and did not find I-94 for mother. I did attach Supplement-I with my mother's details.

    I just happen to look at my application, I-539. I found that I checked the following:
    Members of my family are filing this application with me.
    The total number of people (including me) in the application is: 1

    Is it customary that I only receive I-94 for the principal applicant (in my case) and don't have to worry about?

    If not, please share your thoughts. Do I need to file seperate application for my mother at this point?

    Each person needs to have his/her own I-94. It is an 1-1 mapping between I-94 and passport.

    I happen to hear that its more easy to convert from L1 visa to Green card .Is it something that the employer has to initiate ? Can we start the process by ourselves.

    please shed some light on this.

    You may be eligible to file under EB1-C. Your employer needs to sponsor.

    The NC DMV is taking a really long time to validate my EAD. Its been over 60 days now since my license renewal based on EAD expiring October 2010. They keep sending me back with a temporary license valid for 15 days saying they are yet to validate and issue my perm license based on EAD.

    H1 has been approved for 2009 quota for a client A. it is almost one and half year and the visa stamping has not been done. The client A is no more interested and a new Client B is interested to offer the same position in a different location or at H1 petitioning employers location. The LCA has been filed for the Client B and may get approved in next couple of days. Is that okay to use this new client letter while going for H1B Visa stamping? This new client is not the one on whom the actual H1B petition is approved.

    Question is When going for H1 B visa is it necessary to use the client letter that has been used when applying for H1B approval. Can the clients be different while going for Visa Stamping?

    This is urgent as the visa stamping appointment is in a few days. And the attorneys suggestion will be greatly appreciated.

    Shouldn't be an issue. Make sure you carry documents showing evidence that you have been working for Client A and recently switched to Client B.

    I have a degree that is equivalent to 4 years of education and is from the US.

    Can you give me more information around the question that can I file H1B as an IT consultant with a Bachelors degree in healthcare?

    I have ETA number for my application, is there any way to get PERM related information out of it for pending application? Is ETA number enough for AC21?

    I am on H4 visa and my husband is on H1 visa. My husband is working in N.Y. city as a programmer analyst.

    I am pregnant by 5 months. I have following questions :-

    - Can I apply for Medicare benefits. By applying Medicare benefits I will get free milk,baby food and medical treatments.

    - By applying Medicare does it affects my husband green card process or in future citizenship.

    Thanks for your time and efforts to answer my questions.

    I am not sure about the Green Card and Citizenship is required... but to get the Medicare Benifits your Anual income should not exceed by certain amount which is set by State Department...check that.
