    Hi,

    I'm in a strange situation. I just got my green card (I have an L2) yesterday so it is great news. But somehow, today I was checking my EAD since it becomes obsolete and I just realised that I completely forgot to renew it before it expired 2 months ago, early January. So it means that I worked the past 2 months with my expired EAD but got my green card nevertheless.
    Do you have any advice as what I should do? Should I check with my HR about the EAD...

    Hello everyone,

    I was scheduled to go to an I485 interview(PD: March 2006) at the end of this month.

    Here is my situtation, my H1B was expired at 08/15/09 and I renewed my expired EAD(expired in January, 2009) on 07/30/2009. However my previous employee laid me off on 08/31/09. Before I got my new EAD on 11/18/09 and started my new job on 11/23/09, there was a period of time(from 09/01/09 to 11/22/09) that I was umemployed without a valid H1B or EAD.

    Is that a big deal when I go to the interview? If it is, does anyone want to provide any advice?

    AR-11 has to be filed by all non-citizens, that translates to GC holders or permanent residents as well.
    You dont have to provide COS for I-140 if all correspondence is going to your employer and you dont have any other pending application

    Gurus,
    Today i received a mail(04/12/2009) .Uscis issued an RFE. I am still waiting for it in mail.
    she is currently in india . coming back on 04/15/2009. will there be any problem for her while coming back. I am july 2007 filer on priority Date eb3 ( 04/23/2003). I have left my employer last year.My 140 was approved on feb 2007. what are my options.

    Is your wife travelling on H4 or AP.In both cases she should be fine.If she will travel on H4 then this is totally unrelated as your H1 is still valid and and she will be fine,if she is on AP then after RFE your case is suspended for about 3 weeks when you reply for the RFE and according to me she will be safe in the interim period of suspension to travel.
    Please consult your attorney for confirmation.

    not sure if moving to another state is a option...
    but i can think of..
    1) cancel the insurance
    2) apply for another insurance effective from your return date, cancel the existing insurance.
    3) take min liability only
    4) see if they can suspend it for 2 months.

    Do you have the rejection letter along with the returned application or is that with the lawyer?

    IMHO- it will better to resend the application that got rejected- rather than sending a fresh application
    I was in a similar situation - when my wifes application was lost
    my lawyer suggested- an i agreed- that we wait for her app to show up rather than reconstructing a new one

    Also the rejection letter will have complete instructions on how to refile
    if for some reason you are not getting cooperation from your lawyer- get a new lawyer- If I were you- I wouldn't try to re-file with a lawyer...

    Hi all,

    I graduated this June and started working in a company on my OPT status (valid July 2009 to July 2010) since July until now. In October, my company filed H-1B petition, and on Nov 24, we got approval notice I-797B (without I-94) instead of I-797A, as well as a DENIAL of concurrent change of status.

    Shortly after we filed the petition, I took a short trip to my home country and then come back(with OPT status) on Nov 1.

    In the notice, it states "...the beneficiary departed the US on Oct. 15 2009, thereby abandoning the requested change of status. As such, the beneficiary has failed to maintain his F-1 status. Accordingly, the concurrent request for change of nonimmigrant status is denied."

    I am really confused here because I re-entered the US with my F-1 OPT status on Nov. 1 without any issue.

    What should I do now in order to get my H-1B visa? Am I still maintaining F-1 status (legally staying in the US) even if it stated that I have failed to??

    so does it means I can have only one GC (I485) processing at a time ? I can't have two GC(I-485) processing in parallel , one dependent I-485 which was filed through my husband's and another one filed under my own GC processing ? Actually, as I already have I-485 filed under EB3 and was planning to file another one under EB2 and though I will take the one whichever gets approved first. Also, this way there will be a backup plan as well. But seems like that is not feasible..huh (

    Hi,
    My case is a bit complicated. So, your advice will be of great help.
    Shortly after arriving to the country, without knowing much about immigration laws, my company applied for an EB3 PERM labor certification, although I hold a Master's degree! But, my company lawyers lack any experience! Anyway, the LC was approved in October. However, as you have guessed, retrogression was there, and I've started the waiting phase.

    After reading more about rules and law, I've decided to ask the lawyers to file using EB2. One month later, they've filed another LC in EB2. Naturally, this one was rejected because DOL doesn't allow multiple filing for the same position! Once more, my lawyers proved their inefficiency, and said, it's a mistake and filed for an appeal. Until this day, the appeal is in limbo, because the guys at DOL don't even want to look at at. All our requests for info went unanswered!

    Anyway, now the visa bulletin for June shows that my EB3 date has become really close, it's June 2005 for my case (EB3 World), while my PD is July 2005! I thought, finally it's time to go on with I-140. Asking my lawyers, they've adviced that I should withdraw my EB3 and the stalled EB2 and file another EB2!!! Of course I wondered as you did, "why didn't they say so earlier", but their answer was that the law and company rules just changed!

    Well, instead of risking both EB3 and EB2, I've asked to withdraw the non moving EB2 only, and see what happens in July visa bulletin, which I believe would move at least by a month. I'm still waiting for my EB2 withdrawal decision too.

    So, my question to the experts on this forum, what should I do next? Let's say my EB3 PD becomes current, should I just file for my green card, and hope it doesn't retrogresses while my application is being processed?
    Or should, I withdraw my EB3 too and start the whole process in EB2. I'm very worried an EB2 LC request would gets complicated this time too! At the same time, I'm worried the EB3 category gets retrogressed while my I-485 is being processed and I would have to wait even longer. What do you think?

    Hi,
    1)How long is the duration for University H1?Is it also 3+3 years like regular industry H1?
    2)Can we do part time Phd on university H1 working with university?
    3)Is there any extension after 6 yrs for university H1?
    4)Can one apply for Greencard on this University H1?

    I entered on a H4 on my New Zealand passport and it is valid 2010. I now have a H1B ie a I-797A and a new I-94 that is also valid till 2010. I'm leaving the country for the first time to go to Australia.

    Do I need to get a new visa stamp for my passport?

    If you want to enter US as an H1-B, you will need an H1-B visa stamp on your passport.




    If I need to get a new visa stamp, do I need to go back to New Zealand or can I do it in other countries?


    You can do that from any consulate. However, note that there is a possibility that the IO will need a so-called "security check" which takes 2-3 months (and sometimes, years). In that case, you will be stuck outside US (you cannot get back to US while the security check is pending). So it is advisable to go to a country where you have a place to stay for a long time, if needed. For most people, it is their home country. Also the chances of getting a security check is higher if you go to a consulate other than the consulate in your home country.


    Can I travel with my passport which shows the H4 visa and carry with me my I-797A and new I-94 to re-enter the country?

    You can, but then your status will be H4 and you will not be able to work. The principle is that your status is determined by the latest I-94 you receive. To work on H1-B, your latest I-94 (the one you got it while entering US or as attached with the I-797 form) must be for H1-B (the visa status is written on the I-94).

    I posted this question on another thread but its on page 38-39, so thought I might post as a new thread so that I can get some answer to my concerns...

    I renewed my EAD thru e-filing. Everything was ok but the address to send the Confirmation Receipt is TSC. My initial I-485 is at NSC. My address did not change anytime from the time I applied I-485.

    I entered the correct info in question 11..which was:

    Have you ever before applied for employment auth. form USCIS?
    X Yes(if yes, continue below)
    I checked yes

    which USCIS office?

    My answer:

    LINCOLN, NE date: 08/14/2007

    Should I be worried about this or can I just feel its okay?

    Is this something okay?

    ****** I have searched all related posts but could not find an answer ********
    I have applied my labor in EB3 category. As i am qualified for the senior position i have asked my management for the next level. so that i can apply in EB2 and get the priority data transferred from EB3 application.

    with the July fiasco applied I485 with the EB3 application. Now my management is working to promote me from software dev to Sr software developer. Should i accept the promotion? my job responsibilites will be same with additional responsibilities. What will happen to my i-485 application if i take the promotion?

    I believe, you can accept this promotion without any effect on your pending I-485. Remember though not all promotions are fine. For example you cannot get promoted from a developer position to manager position and continue your case without filing new LC & I-140. Please consult any good lawyer for advice.

    In your case now you have 2 options after getting promoted. Either continue your case in EB3 category without doing anything or appy for new labor & I-140 in EB2 category and have the pending I-485 attached to your new EB2 I-140. Ofcourse here I am assuming that the new job requirement falls under EB2 and you are qualified for EB2.
